A trust separates legal ownership from beneficial ownership. The settlor places property under an obligation that binds the trustees to control and administer that property for the beneficiaries. The trust assets are registered in the trustees' names, or in another name on their behalf, but remain a separate fund rather than part of the trustees' personal estates.
